Declaration of Performance

The Building Materials Regulation (2013 / 305 / AB), published in 2011, aims to:

Explain the basic properties of building materials

To explain the principles of performance declaration for building materials

To establish rules for the CE marking on construction materials

To determine the principles for placing and keeping the building materials on the market

In the preparation of the said regulation, 305 / 2011 / EU Building Materials Directive, which is accepted by the European Union Commission, is based on the harmonization of our current legal regulations with the European Union countries.

Building materials according to this regulation,

With the materials that are produced for permanent use in various construction works and presented to the market.

Materials whose performance affects the performance of construction works on basic requirements

is expressed.

The principles for the declaration of performance of construction materials are discussed in the second part of the regulation. Construction work must take into account the health and safety of people as a whole and the construction materials used must be suitable for the intended use. In short, construction works must meet the basic requirements of construction works, provided that they are produced for an economically acceptable period of use and regularly maintained. The Annex to the Regulation, Basic Requirements for Construction Works, contains the relevant criteria (Annex 1).

The characteristics of the building materials according to the basic requirements of the construction works should be included in the harmonized technical specifications.

In the following two cases, businesses are required to draw up a declaration of performance when placing a building material on the market:

  • If the building material falls within the scope of a harmonized standard,
  • If a European Technical Assessment on construction material has been prepared

Businesses assume this responsibility by issuing a performance statement. Unless there are other information and documents to the contrary, the declaration of performance issued by the entity is considered to be accurate and reliable by the parties concerned.

However, there are some exceptions to making a performance statement. Enterprises are not required to issue a declaration of performance when placing a building material on the market that falls within the scope of a harmonized standard but which is not included in the relevant legal regulations:

  • If the building material is made to order in accordance with a specific construction work and without mass production and is installed by the responsible personnel of the manufacturer.
  • If the building material is manufactured in the construction site for use in the relevant construction works under the responsibility of the manufacturer in accordance with the legal regulations in force.
  • If the building material is produced for the restoration of officially protected buildings in accordance with the principles of the Law on the Protection of Cultural and Natural Heritage, taking into account the architectural and historical values ​​during the preservation of cultural heritage.

Today, businesses operating in the construction sector are required to submit a performance declaration in order to place the CE mark on the building materials they produce. The certificate of performance is included in the relevant processes when applying to the notified bodies for obtaining the CE certificate. In order to obtain a CE certificate, the company's evaluation process must pass positively. Briefly, the construction material produced must be manufactured in accordance with the European Union standards.

In accordance with the above-mentioned Construction Materials Regulation, the enterprises must have their products' type tests carried out and ensure their performance in mass production. For this purpose, the companies that establish the necessary production control systems express their performance and superior features only with the performance declaration. In other words, enterprises take responsibility for the performance of their products with this declaration. In other words, the performance declaration gives the end user assurance on the performance of the products of the enterprise. In this way, the rights of consumers are protected.

On the other hand, the declaration of performance is also important for protecting the rights and interests of the enterprise. Businesses cannot be held responsible for any performance they do not declare.
